A settlement has been reached in a class action lawsuit against Magellan Health Inc. and Magellan RX Management, LLC (collectively “Magellan” or “Defendants”), arising out of a phishing incident in May 2019, which potentially resulted in unauthorized access by a third party to Magellan’s emails and attachments containing the personally identifiable information (“PII”) and/or protected health information (“PHI”) of approximately 273,000 individuals (“Data Incident”).
You are a “Settlement Class Member” if you were mailed a notification that your PII/PHI may have been exposed to unauthorized third parties as a result of the Data Incident.
The Court has granted final approval of the Settlement. Claimants who completed a valid claim were sent their portion of the Settlement payment on February 3, 2023.
Under the terms of the Settlement, Settlement Class Members may be able to recover the following benefits:
- Compensation for Ordinary Out-of-Pocket Expenses, including Lost Time: If you submit a Claim Form showing that you spent money or incurred losses, including lost time, as a result of the Data Incident, you may be eligible for reimbursement up to $225.
- Compensation for Extraordinary Out-of-Pocket Expenses: For certain documented monetary losses, you may be eligible for reimbursement up to $2,500. You must submit a Claim Form to receive these benefits.
